According to TabakerzG §13 (1) Absatz 3, only ingredients that do not pose a risk to human health in heated and non-heated form may be used in the production of liquids. In Germany, Annex 2 (to § 28) of the TabakerzVO specifies the ingredients that are prohibited for use in electronic cigarettes and refillable containers, as they may pose a risk to health. These include additives that have CMR properties in unburned form and are classified as CMR substances of category 1A, 1B or 2 in Part 3 of Annex VI of Regulation (EC) No. 1272/2008.
Liquids and their ingredients should be continuously moni- tored and evaluated to ensure that they are of the highest quality and safety and comply with legal requirements.
All ingredients used in e-cigarettes, other than propylene glycol, glycerine and nicotine, should be listed in Annex
1 of the European Food Regulation EU 1334/2008 and thus be considered safe for food. This does provide reas- surance on the purity and systemic toxicity aspect of the ingredients.
Additional risk assessment considerations should be taken into account with regards to inhalation and potential for thermal degradation in the general and quantitative use of the respective ingredient from use in e-cigarettes.
